Where can you legally take a hand gun without a CC permit?

Is it legal to carry one in your pack in a .... ?
State Park?
National Forest?
WSA or BLM land?

All without a concealed carry permit. What about shooting in these same areas? I have tried googleing this info but that results are all a bit confusing to me.

If you don't have a concealed firearm permit, you must carry any firearm unloaded, and it must be securely encased and not readily accessible for immediate use.

If the above conditions are met, you can bring it to any of the places you mentioned. As for shooting it, you'd be ok on BLM or Forest Service land (away from any campgrounds, roads, etc.), but I believe discharge is forbidden in state parks.

What is the definition of "unloaded" and "securely encased"?

If I want to take my hand gun along on a hike in the swell or backpacking in the Uintas what would be the proper/legal way to bring my weapon with out a CC permit.

I'd go one step further and break the gun down. Semi-auto, remove the slide, revolver the cyclinder.

Here's Utah's definition of "loaded":

(1) For the purpose of this chapter, any pistol, revolver, shotgun, rifle, or other weapon described in this part shall be deemed to be loaded when there is an unexpended cartridge, shell, or projectile in the firing position.
(2) Pistols and revolvers shall also be deemed to be loaded when an unexpended cartridge, shell, or projectile is in a position whereby the manual operation of any mechanism once would cause the unexpended cartridge, shell, or projectile to be fired.

This means that in order to be considered unloaded, it should take two manual actions to fire the weapon. So for a semi-auto, a full magazine and an empty chamber would be considered unloaded, because you'd have to (1) rack the slide and (2) pull the trigger. For a double-action revolver, you'd have to have the chamber under the hammer and the next chamber in line both empty, so it would require two trigger pulls to actually fire.

Here's their definition of "securely encased":

"Securely encased" means not readily accessible for immediate use, such as held in a gun rack, or in a closed case or container, whether or not locked, or in a trunk or other storage area of a motor vehicle, not including a glove box or console box.

I would think that unloaded and in a case (either a small hard case or one of those fabric zippered cases) inside your backpack would be perfectly legal.

Why not just go get your permit? It's easy and inexpensive. That takes all the guess work out of these situations. Utah has great CCW laws!

I think as long as its in view, you're ok?

Just don't conceal it.

Not sure about state parks, but, in Utah National Parks I believe you're not allowed to have a loaded gun, concealed or not.

State Parks - CC and OC ALLOWED
National Parks - CC or OC NOT ALLOWED
National Forest - CC and OC ALLOWED

As for JP's suggestion to 'break down' the pistol, that is absolutely not necessary.

Just get the CFP and know that you are safe to carry anywhere you want except the airport, federal buildings and national parks.
